GermanTutor.ai is an AI-powered language-learning platform designed to help users practice German and other supported languages through features that may include AI conversations, speaking practice, pronunciation feedback, vocabulary, grammar assistance, role-play scenarios, learning activities, progress tracking, and AI-powered language assessment or certificate features.

Some features may be available for free, while others require a paid subscription, one-time payment, or another paid plan. The exact features, usage limits, availability, and pricing of each plan are shown on the Service or during checkout.

You must provide accurate and current information when creating or maintaining an account. You are responsible for maintaining the confidentiality of your login credentials and for activities performed through your account.

You should notify us promptly if you believe your account has been accessed without authorization. You may not create accounts using false identities, impersonate another person, or use another person’s account without permission.

Users who are minors must have the permission of a parent or legal guardian where required by applicable law. Children under 13 should not create a direct consumer account unless GermanTutor.ai expressly provides an age-appropriate account, parent-authorized arrangement, or educational program that complies with applicable law.

GermanTutor.ai uses artificial intelligence and related technologies to provide language-learning experiences.

AI-generated responses, corrections, translations, pronunciation feedback, explanations, assessments, scores, and recommendations may not always be complete, accurate, or appropriate for every situation.

You are responsible for deciding how to use information generated by the Service.

GermanTutor.ai is designed to help users practice and improve language skills, but individual results vary.

We do not guarantee that use of the Service will result in a particular CEFR level, examination result, school grade, employment result, immigration outcome, academic admission, or level of fluency.

Learning progress may depend on factors including your existing ability, frequency of practice, learning methods, and individual circumstances.

GermanTutor.ai may offer free access, paid subscriptions, one-time paid plans, promotional plans, trials, or other forms of access. Features and usage limits may differ between plans.

Before you purchase a paid plan, the checkout page will identify the applicable price, billing period, key plan features, and whether the plan renews automatically. Any promotional or introductory pricing may be subject to additional conditions disclosed at the time of purchase.

By purchasing a paid Service, you authorize the applicable payment provider to charge the payment method you provide for the amount shown at checkout, including applicable taxes where required.

Payments may be processed by independent third-party payment service providers. Their terms and privacy practices may also apply to payment processing.

You are responsible for providing valid payment information and for keeping your billing information up to date. Prices may vary by country, currency, plan, promotion, platform, or purchasing channel.

If you purchase a subscription identified at checkout as automatically renewing, your subscription will continue and your payment method will be charged at the beginning of each new billing period unless you cancel automatic renewal before the next renewal charge.

Before purchase, we will disclose the applicable subscription period, price, billing frequency, and automatic-renewal nature of the plan.

Where required by applicable law, we may also provide renewal reminders, price-change notices, or other subscription notices. If the price of your subscription changes, we will provide notice where required before the new price becomes effective.

Your continued subscription after a properly notified price change constitutes acceptance of the new price where permitted by law.

You may cancel the automatic renewal of your subscription through the subscription-management options made available through the Service or by another cancellation method we provide.

If you purchased your subscription through a third-party platform, app store, payment provider, or reseller, you may need to manage cancellation through that provider.

Cancelling automatic renewal prevents future renewal charges. Unless a refund is granted or applicable law requires otherwise, cancellation normally does not end access immediately and your paid access may continue until the end of the current paid period.

GermanTutor.ai provides a limited contractual refund policy for qualifying initial purchases and automatic subscription renewals.

Under our standard policy, both of the following conditions must be satisfied:

Additional or different refund, cancellation, withdrawal, or remedy rights may apply under mandatory consumer laws in your country or region. Nothing in this section limits rights that cannot legally be excluded or waived.

Approved refunds will normally be returned through the original payment method. Processing times may depend on the payment provider, card issuer, bank, or other financial institution.

If GermanTutor.ai offers a free or discounted trial that automatically converts into a paid subscription, the duration of the trial, the price that will apply afterward, and the applicable renewal terms will be disclosed before enrollment.

You must cancel before the applicable billing date if you do not want the paid subscription to begin or renew. Different promotions may have different eligibility rules and may not be combined unless expressly stated.

You may use GermanTutor.ai only for lawful purposes and in accordance with these Terms.

You must not:

• misuse the Service or interfere with its normal operation;
• attempt to bypass usage limits, payment controls, access restrictions, or security measures;
• access accounts, data, systems, or networks without authorization;
• use automated systems to excessively extract content or data;
• introduce malware, harmful code, or security threats;
• engage in fraud, payment abuse, impersonation, harassment, or unlawful activity;
• use the Service to violate another person’s rights; or
• resell, sublicense, commercially redistribute, reverse engineer, systematically copy, scrape, or reproduce substantial portions of the Service except where expressly authorized or permitted by law.

You may provide text, voice recordings, answers, messages, prompts, learning preferences, or other content when using the Service (“User Content”). You retain any ownership rights you have in your User Content.

You grant Windvale LLC a limited right to host, process, transmit, reproduce, and otherwise use User Content as reasonably necessary to operate the Service, provide requested AI and language-learning functionality, maintain security, provide support, comply with law, and perform other activities described in our Privacy Policy.

This permission does not transfer ownership of your User Content to Windvale LLC. You must have the necessary rights and permissions to submit any content you provide through the Service.

The GermanTutor.ai Service, including its software, interface, design, branding, logos, learning materials, original text, graphics, databases, and other proprietary content, is owned by or licensed to Windvale LLC and is protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purposes. These Terms do not transfer ownership of GermanTutor.ai intellectual property to you.

GermanTutor.ai may provide AI-powered assessments, progress records, language-level indicators, or AI Language Certificates to eligible users.

Unless expressly stated otherwise, these features represent assessments generated through the GermanTutor.ai learning system and are not government-issued qualifications, university degrees, professional licenses, immigration credentials, or official examination certificates issued by third-party examination bodies.

Third parties, schools, employers, institutions, or authorities may decide independently whether and how they recognize such certificates or assessments. We do not guarantee acceptance of a GermanTutor.ai certificate by any third party.

GermanTutor.ai may provide Teen Protection Mode or other safeguards intended to create a more age-appropriate learning experience.

These safeguards supplement, but do not replace, parental consent, school authorization, age-assurance requirements, or other legal obligations that may apply.

Parents, guardians, schools, and educational organizations remain responsible for supervising minors where required by law or by their own policies.

GermanTutor.ai may offer services to schools, universities, educational organizations, companies, or other institutions.

Institutional users may be subject to additional agreements, order forms, data-processing agreements, administrator policies, or other terms. Where an organization provides or manages your account, that organization may have administrative controls over certain account features or learning information consistent with the applicable agreement and Privacy Policy.

If a separate written agreement between Windvale LLC and an organization conflicts with these Terms, the separate agreement will govern to the extent of that conflict.

We work to keep GermanTutor.ai available and useful, but we do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable because of maintenance, security issues, technical failures, internet or infrastructure problems, third-party providers, or events outside our reasonable control.

We may update, improve, add, remove, or modify features over time. For material changes that significantly affect an ongoing paid service, we will provide notice or remedies where required by applicable law.

Nothing in this section permits us to remove or limit mandatory consumer remedies.

We may restrict, suspend, or terminate access to the Service if we reasonably believe that you have materially violated these Terms, engaged in fraud or unlawful activity, created security risks, abused the Service, failed to pay amounts properly due, or used the Service in a way that may materially harm GermanTutor.ai, other users, or third parties.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue before termination. We may take immediate action where necessary for security, fraud prevention, legal compliance, or protection of users or the Service.

Termination does not eliminate rights or obligations that arose before termination.

Your use of GermanTutor.ai is also subject to our Privacy Policy.

The Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including information associated with accounts, learning activity, conversations, voice features, payments, and support.

GermanTutor.ai may rely on or link to third-party services, including payment processors, cloud infrastructure, artificial-intelligence providers, speech technologies, authentication services, analytics providers, or external websites.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for independent third-party services to the extent permitted by applicable law, although this does not affect any responsibility that applicable consumer law places directly on Windvale LLC.

GermanTutor.ai provides an AI-assisted educational service. Because AI systems and language technologies can make mistakes, you should not rely on the Service as the sole basis for decisions that could have significant legal, financial, academic, employment, immigration, health, or safety consequences.

To the maximum extent permitted by applicable law, Windvale LLC does not guarantee that the Service will always be uninterrupted, error-free, completely accurate, or suitable for every individual purpose.

Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited, including rights or remedies available under applicable consumer-protection law.

For consumer users, any exclusions or limitations in these Terms apply only to the extent permitted by the mandatory laws applicable to that consumer.

For business or institutional users, unless a separate written agreement provides otherwise, Windvale LLC’s aggregate liability arising from the Service will, to the extent permitted by law, not exceed the fees paid for the applicable Service during the 12 months preceding the event giving rise to the claim.

Governing law and consumer rights

These Terms are generally governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply in your country, state, province, or region. Where applicable law permits you to bring a claim in your local courts or provides other mandatory dispute rights, those rights remain available.

Before starting formal proceedings, we encourage users to contact us so that we can attempt to resolve the issue, but doing so does not prevent you from exercising any legal right or meeting any legal deadline.

Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service, applicable law, security requirements, or our business practices.

If a change materially affects your rights or an ongoing paid subscription, we will provide notice where required by law. Material changes will not be applied retroactively where doing so would be prohibited by applicable law.

The version posted on GermanTutor.ai will identify the date it was last updated.
